How old is the participant?

This is the person receiving DD Waiver services — typically your child or the individual you're a parent/guardian for.

Are you the legal guardian of this adult participant?

In Wyoming, a parent who is also the legal guardian of an adult DD Waiver participant is not eligible to be the paid Personal Care provider. A parent who is not the legal guardian may be eligible.

Quick primer: When an adult has a legal guardian, that guardian makes major life decisions on their behalf. Many adult DD Waiver participants do not have a legal guardian — they may have a supported decision-making arrangement, a representative payee, or manage their own affairs.

Does your child qualify for "extraordinary care"?

For a parent of a minor to be paid as a Personal Care provider under Wyoming's DD Waiver, the child must meet the criteria for extraordinary care.

Both of the following must be true:
  • The participant's Adaptive Behavior Quotient (ABQ) is 0.35 or lower on the ICAP assessment
  • AND the assistance they need goes beyond what a legally responsible parent would normally do for a same-age child without a disability

Here's what to know next — and what your income could look like.

A few important rules to know
You need a provider connection. A relative can only provide paid Personal Care by either (a) becoming a certified provider with an LLC or corporation, or (b) working as an employee of an already-certified provider agency.
There's a daily cap. Paid hours for a relative provider cannot exceed 4 hours per day — which works out to a maximum of 5,840 units (1,460 hours) per year.
It has to be in the IPC. The number of service units must be justified in your Individualized Plan of Care, based on the participant's assessed needs.

⚖️ Guardianship review (adults)

Some families explore supported decision-making as an alternative to guardianship. Talk with your case manager and a family-law attorney before making changes.

📋 Re-assess needs (minors)

If your child's needs have changed, an updated ICAP assessment may lead to a different result. Your case manager can request a reassessment.
